Zenide provides users with access to a collection of resources, including but not limited to, software development tools, information, and applications (the "Service"). You also understand and agree that the Service may include advertisements and that these advertisements are necessary for Zenide to provide the Service. You also understand and agree that the Service may include certain communications from Zenide, such as service announcements, administrative messages and newsletters, and that these communications are considered part of Zenide membership and you will not be able to opt out of receiving them. Unless explicitly stated otherwise, any new features that augment or enhance the current Service, including the release of new Zenide properties, shall be subject to this Terms of Service.

3. User Conduct

You agree to not use the Service to:

Upload, post, email, transmit or otherwise make available any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable;
Harm minors in any way;
Impersonate any person or entity, including, but not limited to, a Zenide official, or falsely state or otherwise misrepresent your affiliation with a person or entity;
Forge headers or otherwise manipulate identifiers in order to disguise the origin of any Content transmitted through the Service;
Upload, post, email, transmit or otherwise make available any Content that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);
Interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service.

4. Intellectual Property

The Site and its original content, features, and functionality are owned by Zenide and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. This agreement does not transfer to you any Zenide or third-party intellectual property, and all right, title, and interest in and to such property will remain (as between the parties) solely with Zenide.

5. Disclaimer of Warranties

The Service is provided "as is". Zenide and its suppliers and licensors hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement. Neither Zenide nor its suppliers and licensors, makes any warranty that the Service will be error free or that access thereto will be continuous or uninterrupted. You understand that you download from, or otherwise obtain content or services through, the Service at your own discretion and risk.

6. Limitation of Liability

In no event will Zenide, or its suppliers or licensors, be liable with respect to any subject matter of this agreement under any contract, negligence, strict liability or other legal or equitable theory for: (i) any special, incidental or consequential damages; (ii) the cost of procurement for substitute products or services; (iii) for interruption of use or loss or corruption of data. Zenide shall have no liability for any failure or delay due to matters beyond their reasonable control. The foregoing shall not apply to the extent prohibited by applicable law.

7. Indemnification

You agree to indemnify and hold harmless Zenide, its contractors, and its licensors, and their respective directors, officers, employees, and agents from and against any and all claims and expenses, including attorneys' fees, arising out of your use of the Website, including but not limited to your violation of this Agreement.

8. Governing Law
